Abstract

The financing model of infrastructure investment, in Brazil, carried out almost exclusively by the federal government, combined with the fiscal constraints that the country has been going through, prompted the beginning of the discussions that took place in 2009- 2010, between the federal government and civil society, to stimulate private funding. These discussions resulted in the publication of MP 517/2010, converted into Law nº 12.431/2011, which created the infrastructure debenture. The motivation for the creation of this financial instrument was based on the forecast of large investments in the following years and the impossibility of BNDES to continue as an almost exclusive financing of infrastructure investments. Infrastructure debenture began to be issued in 2012, following a process of adjustment to the newly created law, to clarify some situations that generated doubts in the market, and after its regulation. In the ensuing years, the volume of emissions increased gradually. The objective of this work is to answer the question: Why have infrastructure debenture not been able to promote a better balance between the public and private sectors in the long-term financing of infrastructure investments? For this, the construction of the work was based on bibliographic surveys, in newspapers, working group minutes created within the federal government and studies prepared to discuss the creation of a long-term financing instrument for infrastructure financing, and semi-structured interviews were conducted to gather undocumented information concerning the implementation of the infrastructure debenture instrument. It is concluded that there are institutional barriers which make it impossible to issue infrastructure debenture at all stages of investment projects. The debentures are more consistent with the lower risk phases of the project. The participation of the infrastructure debenture also varies according to the sector. Infrastructure sectors are heterogeneous, and infrastructure debenture have a greater participation in some sectors than in others.
