Abstract

This paper deals with the regulatory experiments in the United States, United Kingdom and three Latin American countries - Argentina, Chile and Mexico. The social mechanisms that limit regulatory discretion (laws, legislative and executive institutions, etc.) determine the framework in which explicit regulatory constraints (tariff schemes, the entry of new firms, interconnections, etc.) will be traced. Network regulation to guarantee access on fair terms is crucial, but it is still not well accepted by the network owners. British regulator shares the decision-making with other institutions, but that is not true for US regulatory standards. However, American judicial reviews are widespread. In particular, the increasing movement of mergers and takeovers, mostly in the US, weakens the agency regulation and strengthens antitrust regulation. British and American regulators are supposed to either publishing careful reports and recommendations or providing interested groups with information about new rules. At Argentina and Chile, stands the split of regulatory powers which raises questions about the credibility of regulatory efficiency. Resources specifically alotted to the regulatory agencies have revealed to be na important way to deter others from modifying regulatory system toward their own interests. International experience has shown that rate-of-return or price-cap criteria, both enforced by the regulator, are somewhat arbitrary. As far as electric power and telecommunications are concerned, a very important regulatory matter at the American States is the increasing application of incentive regulation. Hybrid schemes are being applied in Argentina and Chile; in other words, price-cap, rate-of-return and benchmark.
