Abstract
O artigo pretende examinar de um ponto de vista comparativo os diferentes regimes regulatórios existentes. Três categorias principais emergem: a tradicional regulação da taxa de retorno (RTR); a regulação por limite de preços; e a chamada regulação por incentivos, que envolve repartição de rendimentos acima de uma taxa de retorno de referência. Examinamos a questão do incentivo em regulação tomando como referência a literatura teórica recente. Existem reduzidos incentivos para diminuição de custos sob RTR. As formas alternativas de regulação, embora em princípio superiores, estão também algo distantes de um ideal teórico.

This paper aims at examining from a comparative point of view the different existent regulatory regimes. Three main categories arise: the traditional rate-of-return regulation (RTR), the price-cap regulation and the so called incentive regulation that involves earning sharings above some reference rate-of-return. We examined the incentive issue in regulation taking as reference the recent theoretical literature. There are low incentives for cost reduction under RTR. The alternative forms of regulation, though in principle superior, are also somewhat distant from a theoretical ideal.
