Social protection legislative frameworks in South Asia from a children's rights perspective

Abstract

An important element of social protection systems are regulatory frameworks. The absence of a legal framework for social protection leaves individuals and communities in need exposed to arbitrary decision-making and political change. A strong statutory basis which recognises social protection as a right ensures accountable institutions and enables individuals to make legitimate claims and enforce their rights, thus creating legal awareness, which is central to the legal empowerment of the most vulnerable members of society. This One Pager summarises the findings of a recent IPC-IG Research Report, which assesses the state of children's right to social protection by analysing the legal frameworks supporting national social protection systems.

Um elemento importante dos sistemas de proteção social são os marcos legais. A ausência de um marco legal para a proteção social faz com que indivíduos e comunidades sejam expostos à tomada de decisões arbitrárias e mudanças políticas. Uma base legal robusta que reconhece a proteção social como um direito garante instituições responsáveis e permite que indivíduos realizem reivindicações legítimas e façam cumprir seus direitos, criando, assim, uma consciência jurídica, que é fundamental para o empoderamento legal dos membros mais vulneráveis da sociedade. Este One Pager resume as conclusões de um Relatório de Pesquisa do IPC-IG, que verifica o estado atual do direito das crianças à proteção social, analisando os marcos legais que sustentam os sistemas nacionais de proteção social.
