Abstract

O objetivo deste trabalho é avaliar o impacto da Lei de Responsabilidade Fiscal (LRF) sobre as finanças públicas municipais. A lei estabeleceu limites de gastos e endividamento por meio das relações gastos com pessoal dividido pela receita corrente líquida e dívida consolidada líquida dividida pela receita corrente líquida, as quais não devem ultrapassar os tetos de 0,6 e 1,2, respectivamente. Para essa análise foram traçados dois cenários – “antes” e “depois” da lei –, com base nos quais se comparou o comportamento dos municípios no tocante às suas políticas de gastos e endividamento. A princípio, nota-se que os limites impostos, ao tempo em que foram estabelecidos, encontravam-se distantes da realidade dos municípios brasileiros – isto é, muito acima da realidade dos resultados médios destes. Isso sugere um “erro de calibragem” na fixação daqueles, dado que um dos objetivos era evitar o aumento sem critério dos gastos com pessoal. Os resultados mostraram que, no caso da despesa com pessoal como proporção da receita corrente líquida, a imposição do limite de 60% estimulou o aumento dessa despesa para a maioria dos municípios que apresentavam gastos muito inferiores ao teto determinado. No entanto, a minoria que ultrapassava esse teto se ajustou. Para o indicador de endividamento, a lei gerou um efeito controlador para o pequeno número de municípios que ultrapassava o limite imposto, segundo os resultados encontrados. No entanto, os municípios que não se ajustaram aumentaram sua participação na dívida agregada de todos os municípios. Portanto, nesse caso, notaram-se dois efeitos: além do controle da dívida de alguns municípios, houve uma concentração de endividamento de outros que não foram controlados.

This study aims assessing the impact of the introduction of the “Lei de Responsabilidade Fiscal” (Fiscal Responsibility Law) on the municipal public finance. The Law established limits of indebtedness and expenses by the relations “expenses with public servants payroll over the net current revenue” and “net consolidated debt over the net current revenue” which must not surpass the 0,6 and 1,2 limits respectively. For this analysis, we build two scenarios ("before" and "after" the Law), on the basis of which we compared the municipalities’ performance concerning their expenditures and debt policies. In a first analysis, we observed that the limits imposed to the municipalities were very higher than their average results suggesting “miscalibration” in the setting of those limits since the aim was to prevent the public servants payroll expenses raise without criterion. The results show that in the case of the public servant payroll ratio over the net current revenues, the imposition of a 60% limit worked as an incentive to increase that item of expenditure to most municipalities, which had results much lower than the established ceiling. Nevertheless, the minority that surpassed the ceiling had their expenses adjusted. As for the indebtedness index, the Law brought about a controlling effect to a small number of municipalities that overreached the limit imposed. However, we observed that the municipalities that were unable to fit themselves to the limit increased their participation in the aggregate debt of all the municipalities. Therefore, two effects were detected: a debt control of some municipalities and a concentration of indebtedness in others where the debt was not controlled.
