Abstract

A formação de áreas preferenciais de comércio (APCs) gera a necessidade de comprovação da procedência dos produtos beneficiados pelas concessões tarifárias feitas entre os países-membros, através do cumprimento de determinados requisitos. Essas especificações constituem os regimes de origem. A justificativa desses regimes é impedir a extensão da concessão a produtos e/ou países não contemplados pelo tratamento preferencial. Não obstante, como outras medidas capazes de influenciar o comércio entre países, as regras de origem estão sujeitas a desempenhar o papel de barreiras não-tarifárias, conferindo um maior nível de proteção a alguns setores produtivos. Este trabalho tem como objetivo avaliar o funcionamento dos regimes de origem vigentes no Nafta, no Mercosul e do Sistema Geral de Preferências (SGP) da União Européia (UE) e verificar se o grau de restrição às importações, determinado segundo os tipos de regras de origem, está associado ao nível da tarifa aduaneira. A análise mostra que a incidência de critérios mais rigorosos para conferir origem é mais facilmente detectada em alguns setores considerados “sensíveis” nos países desenvolvidos, como produtos agrícolas, alimentos, têxteis, confecções e calçados.

The institution of special trade relations, such as in preferential-trade areas (PTAs) requires some evidence of the origin of the products that may benefit from the concessions. These conditions constitute the so-called rules of origin. These rules are designed to preclude the exports from outside countries to the PTAs through the country-member with the lowest tariffs. However, like other measures applied in the international trade, the rules of origin can be used as non-tariff barriers and confer higher levels of protection to some sectors. The main purpose of this paper is to analyze the regimes of rules of origin adopted by Nafta, Mercosur and that used by the European Union in its General System of Preferences (GSP). In addition, it will be investigated to what extent the “hidden” protection provided by the use of rules of origin can be associated with differences in the tariff rates. The empirical results suggest that the incidence of more rigorous criteria to confer origin is easily detected in some sectors considered “sensitive” in the developed countries, such as agricultural products, food, textiles and clothing and footwear.
